Public Notice

Merri-bek City Council, acting under Section 114 of the Local Government Act 2020 (the Act), proposes to sell its land at 2 Spry Street, Coburg North known as Certificate of Title 12480 Folio 112.

Council purchased 2 Spry Street, Coburg North in 2018 to provide new open space and improve access and increase the vegetation buffer to Spry St.

The site measured 4,364m² at the time of purchase, since then a DDA compliant elevated platform path was constructed connecting Spry St to the Creek, part of the site was added to the road reserve to improve vehicular movement. The remainder, 857m², has been subdivided and is proposed to be sold with the proceeds of the sale going to the Public Park and Recreation Fund, allowing Council to either purchase new open space land in the municipality or improve current open space sites.

The house on the site, which was built in the 1920s, is in a state of disrepair, its structural integrity requires a report from a structural engineer, moreover it’s been established that the site requires upgrades worth over $350,000.

At its meeting on 13 September 2023, Council resolved to commence statutory procedures to give public notice of its intention to sell the Land and undertake a community engagement process in accordance with its community engagement policy.

It is Council’s intention to sell the land by a public process in accordance with the State Government’s “Local Government Best Practice Guidelines for the Sale, Exchange and Transfer of Land”.

As part of its Community Engagement Policy, Council is inviting submissions on the proposal to sell its site. Any person wishing to make a submission on the proposal must do so in writing by no later than 5.00 pm on Monday 16 October 2023.

Written submissions will be considered in accordance with Council’s Community Engagement Policy. A person making a submission is entitled to request in the submission that they wish to appear in person in support of the submission, or to be represented by a person specified in the submission, at a Hearing of Submissions Committee meeting to be held at a date and time to be determined by Council.

Submissions must be clearly marked “Submission - proposed sale of 2 Spry St, Coburg North” and should be addressed to Liliane Sutherland, Merri-bek City Council, Locked Bag 10, Brunswick 3056, or delivered to the Merri-bek Civic Centre, 90 Bell Street, Coburg or emailed to property@merri-bek.vic.gov.au

Please note that Council is required to maintain and make available for public inspection a register of submissions received in accordance with S223 of The Act during the previous 12 months.

Following the consideration of any submissions, Council may decide to sell or not sell its site.
